Sweeps.us Terms and Conditions

These terms of service require individual arbitration for dispute resolution. Refer to clause 21 for details.

No purchase or payment is required.

To participate in any games or use the platform. Making a purchase or payment will not increase your chances of winning any games. Please carefully read these Terms of Service before using the platform. By accessing the platform, agreeing to these terms via a prompt, or creating a customer account, you acknowledge that you have read, understood, and agree to these Terms of Service, our Privacy Policy, Responsible Social Gaming Policy, Sweeps Rules, and any other relevant terms for game-specific or promotional activities. If you do not agree to these Terms of Service or any related policies, you must not use the platform.

1. Definitions

• Content: Refers to all text, graphics, user interfaces, visual elements, photos, trademarks, logos, sounds, music, artwork, computer code, and other materials available or displayed as part of the games or platform.
• Customer Account: A registered account held by a player.
• Excluded Territory: Refers to the states of Delaware, Idaho, Washington, Nevada, Kentucky, and Michigan in the U.S. and other regions outside the U.S. where participation is restricted.
• Fraudulent Conduct: As defined in clause 10.1.
• Game: Any Gold Coin or Sweepstakes Game available on the platform. We may add or remove games at our discretion and impose limits on your access to the platform.
• Gold Coins: A virtual currency for social gaming purposes. Gold Coins have no cash value and cannot be redeemed for real-world prizes or money.
• Gold Coin Game: Games played with Gold Coins, where no prizes can be won.
• Inactive Account: A customer account with no activity for over 12 consecutive months.
• Payment Administration Agent: A third-party service appointed to accept payments on behalf of King Entertainment Corp.
• Platform: The services provided through the Sweeps.us website and all related subdomains and pages.
• Player/You: Any individual participating in the games on the platform.
• Prizes: Rewards won from playing Sweepstakes Games, redeemable as per the Sweeps Rules.
• King Entertainment Corp.: The company owning and operating the platform, with its address at 30 N, Gould Street, Ste R, Sheridan, WY 82801, USA.
• Registered Customer: A player who has successfully created a customer account.
• Sweeps Coins: Free sweepstakes entries used in Sweepstakes Games. Sweeps Coins cannot be purchased and are available through various free methods as detailed in the Sweeps Rules.
• Sweeps Rules: The set of rules governing the Sweepstakes Games.
• Sweepstakes Games: Games played with Sweeps Coins, where prizes may be won in accordance with the Sweeps Rules.
• Terms of Service: These terms, which may be updated over time.
• Third Party Websites: Websites not controlled by King Entertainment Corp.

2. Operator

2.1 The online social games available on the Sweeps.us platform are owned and operated by King Entertainment Corp. All games and prizes provided on the platform are managed by King Entertainment Corp.

3. Eligibility

3.1 By registering an account or participating in games on the platform, you confirm that: (a) You are at least 18 years old, or the legal age of majority as per the laws of your jurisdiction, and eligible to participate in the platform’s games. (b) You do not reside in or access the platform from any Excluded Territory. (c) Your participation is solely for recreation and entertainment. (d) You participate on your own behalf, not on behalf of others. (e) The information you provide is accurate, and you will update us promptly if it changes. (f) You will not engage in Fraudulent Conduct or illegal activities, including using software-assisted methods or hardware to play the games. We reserve the right to invalidate participation and close your account for such behavior. (g) When purchasing Gold Coins, you will use a valid payment method that belongs to you. (h) You will not sell, trade, or transfer for value any prizes obtained from the platform. 3.2 It is your responsibility to ensure that your participation on the platform complies with the laws of your jurisdiction. Providing false or misleading information, or attempting to bypass location restrictions, may result in termination of your account and potential legal action. 3.3 Employees of King Entertainment Corp., its affiliates, subsidiaries, advertising agencies, or any individual involved in the design, production, or distribution of the platform, and their immediate families, are ineligible to win prizes. 3.4 By accepting these Terms of Service, you acknowledge that your participation in the platform is entirely at your discretion.

4. License

4.1. Subject to your compliance with these Terms of Service, King Entertainment Corp grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable, and limited license to access and use the Sweeps.us platform via a supported web browser or mobile device, strictly for your personal entertainment purposes. 4.2. These Terms of Service do not grant you any ownership or interest in the platform or its content. 4.3. You acknowledge and agree that your license to use the platform is conditional upon your compliance with these Terms of Service. If you do not agree with or violate these terms, your license to use the platform (including the games and content) may be revoked immediately. 4.4. If using the platform or participating in any game is deemed illegal in your jurisdiction, you are not permitted to access the platform or any games.

5. Customer account

5.1. You are permitted to have only one customer account on the platform, including any inactive accounts. If we find that you have multiple accounts or are sharing an account, we reserve the right to suspend or terminate any or all of your accounts and invalidate or withhold any prizes or redemptions. 5.2. You must notify us immediately if you become aware that you have more than one registered customer account. 5.3. It is your responsibility to keep your registration details up to date. If there are any changes in your address, email, phone number, or any personal information, you must notify us by contacting [email protected]. The name provided during registration must match your government-issued identification. 5.4. During registration, you will be required to choose a password to log into the platform. 5.5. You are solely responsible for maintaining the security of your login details and payment methods. Any unauthorized activity linked to your account is your responsibility. 5.6. You must not share your account details, including your password, with anyone else. You are also responsible for ensuring that you log out after each session, especially when using a public or shared computer, to prevent unauthorized access to your account. 5.7. If you suspect that your account’s security has been compromised, such as through the loss or theft of your password, you must notify us immediately. 5.8. You are solely responsible for any activity conducted through your account, including any purchases, whether authorized by you or not. 5.9. You acknowledge that your account may be terminated if unauthorized persons access it and engage in any activity that violates these Terms of Service or is illegal. 5.10. We are not responsible for any misuse of your account due to your disclosure of login details to third parties, whether intentional or accidental. 5.11. You may not transfer Gold Coins or Sweeps Coins between accounts or to other players. Any attempt to transfer, sell, or acquire accounts will result in the termination of your account. 5.12. If your account becomes inactive, we reserve the right to deactivate it. Any unredeemed prizes associated with an inactive account may be forfeited. 5.13. You may request to close your account at any time by contacting [email protected]. Upon account closure, you forfeit access to any Gold Coins, Sweeps Coins, or unredeemed prizes. 5.14. You may be able to reopen your account by sending a request to our customer support team at [email protected]. 5.15. We reserve the right to decline requests to reopen an account at our discretion.

6. Games and gold coin Purchases

6.1. Each game on the platform may have its own rules, which are available within the platform. It is your responsibility to familiarize yourself with the game rules before playing. 6.2. Any foreign exchange transaction fees, charges, or costs associated with your Gold Coin purchases are your responsibility, including any fluctuations in currency exchange rates. 6.3. By associating a payment method with your account to purchase Gold Coins, you confirm that you are the lawful owner of the payment method used. Any use of a payment method that is not yours will be considered a violation of these Terms of Service. We reserve the right to suspend or terminate your account without notice if a chargeback occurs or if you use an unauthorized payment method. In the event of a dispute over ownership of a payment method, the registered account holder will be considered the purchaser. 6.4. King Entertainment Corp works with third-party Payment Administration Agents to process payments. You may be required to accept their terms and conditions, and it is your responsibility to understand these terms. We may request additional documentation to verify the ownership of your payment method. 6.5. You can only participate in a game if you have sufficient Gold Coins or Sweeps Coins in your account. We do not offer credit for Gold Coin purchases. 6.6. From time to time, we may establish minimum or maximum purchase limits for Gold Coins as displayed on the platform. 6.7. Once a Gold Coin purchase has been made, the payment will be processed promptly. All purchases are final and non-refundable. You must notify us within 30 days of any billing discrepancies. Failure to do so waives your right to dispute the issue. You are responsible for any chargebacks, claims, or fines that arise from your account. 6.8. The purchase of Gold Coins grants you a license to participate in Gold Coin games, but Gold Coins have no real monetary value. They are non-refundable, non-transferable, and cannot be exchanged for cash. 6.9. Once Gold Coins or Sweeps Coins have been used in a game, they cannot be altered or canceled. The relevant amount will be deducted from your account immediately. 6.10. If any of your purchases are charged back or reversed, your account will be suspended, and any winnings or redemptions will be void until the outstanding balance is paid. 6.11. In accordance with the Sweeps Rules: (a) Unless otherwise stated, any Sweeps Coin allocated to you must be played at least once before it is eligible for redemption as a prize. (b) At our discretion, we may require you to play a higher number of times before Sweeps Coins are eligible for redemption. 6.12. We reserve the right to declare any game participation or results void if errors, technical issues, or software malfunctions are detected. 6.13. In case of a discrepancy between the result on your device and the result recorded on King Entertainment Corp’s server, the server result will prevail.

7. Promotions

7.1. All promotions, including Sweepstakes Games, contests, special offers, and bonuses are governed by these Terms of Service, the Sweepstakes Rules, and any additional terms provided at the time of the promotion. 7.2. If there is any inconsistency between these Terms of Service and the terms specific to a particular promotion, the promotion-specific terms will take precedence. 7.3. King Entertainment Corp reserves the right to change or cancel any promotion without prior notice. 7.4. If, in the reasonable opinion of King Entertainment Corp, it is determined that a registered customer is misusing any promotion to gain an unfair advantage for themselves or another customer, including through fraudulent activities, King Entertainment Corp may, at its discretion, withhold, deny, or cancel any advantage, bonus, or prize. 7.5. You grant King Entertainment Corp a perpetual, worldwide, non-exclusive, royalty-free license to use any content you submit or post as part of a promotion, contest, or competition, in any way they deem appropriate, without additional acknowledgment of you as the author.

8. Redemption of prizes

8.1. Subject to these Terms of Service: (a) Prizes will be paid to the same payment method used for purchasing Gold Coins; or (b) If this is not possible, then to an alternate bank account you designate. (c) We reserve the right to require the same payment method for the redemption of prizes as was used for purchasing Gold Coins, or a specific payment method of our choice. 8.2. You agree that before any prize is redeemed, we have the right to perform any identity, credit, or verification checks necessary or required by law or regulatory authorities. 8.3. Until the required verification checks are completed: (a) Your request for prize redemption will remain pending; and (b) We may restrict your account, including by suspending or deactivating it, if deemed necessary. 8.4. We will conduct additional verification checks for any prize redemption request of $2,000 or more and reserve the right to do so for lesser amounts. This may include requiring photo ID and proof of address. 8.5. If any requested documents are not provided within 30 days of the initial request, we may, at our discretion, deactivate your account and forfeit any unredeemed prizes. 8.6. If you attempt to redeem prizes from a deactivated or suspended account, please contact customer support at [email protected]. 8.7. King Entertainment Corp reserves the right to conduct external verification checks on all cardholders with third-party agencies. 8.8. We may charge fees for processing prize redemptions and set a minimum redemption amount of $50. 8.9. In New York and Florida, the maximum prize redemption per spin or play is capped at $5,000. 8.10. We reserve the right to limit daily prize redemptions to $500 at our discretion. 8.11. You are responsible for ensuring that your financial institution can accept prize payments. King Entertainment Corp is not responsible for confirming this on your behalf. 8.12. Subject to clause 8.13, prizes will not be paid into an account or payment method that does not match the name on your customer account. 8.13. Prizes redeemed for cash: (a) May be paid into a joint account if one of the account holders matches the name registered on your account, and both parties pass our verification checks. (b) Will not be paid into accounts held by minors, custodial accounts, or accounts held in trust for minors. 8.14. You are responsible for ensuring that any bank details you provide are accurate. Once a payment is processed, we cannot reverse or reissue the payment if the details were incorrect. 8.15. If your financial institution does not accept the payment, you must nominate an alternative account. Failure to do so within 60 days may result in the forfeiture of the prize. 8.16. Direct bank transfers will be made in USD, and you are responsible for ensuring that your account can accept USD transactions. 8.17. Any foreign exchange fees or losses incurred due to currency conversion are your responsibility. 8.18. Prize redemption requests are processed in the order they are received, and we aim to fulfill them as quickly as possible. 8.19. Only one prize redemption request will be processed per account within any 7-day period. 8.20. It may take up to 10 business days to process a prize payment to your nominated account. 8.21. There may be additional delays due to verification checks required for certain payment methods. 8.22. Payments over $5,000 may require additional clearance and may be paid in installments. 8.23. We reserve the right to allocate or pay prizes in smaller increments if deemed necessary. 8.24. We may appoint Payment Administration Agents to process payments on our behalf. 8.25. A Payment Administration Agent will have the same authority as King Entertainment Corp in handling payments and will not be liable for any loss or damage caused by their actions. 8.27. Sweeps Coins will expire 60 days after your last login. 8.28. Sweeps Coins may be forfeited if your account is deactivated or at our discretion. 8.29. You can update payment details by logging into your account, but we cannot update them for you. 8.30. If you decline a payment to your nominated account more than twice in three months, we reserve the right to suspend your account. 8.31. If your account is mistakenly credited, the funds remain the property of King Entertainment Corp and must be returned. Please contact customer support immediately if this occurs.

9. Responsible social gaming

9.1. King Entertainment Corp supports responsible gaming and encourages customers to use available tools for managing their accounts. Please review our Responsible Social Gaming Policy for more information. 9.2. While we strive to enforce responsible gaming policies, King Entertainment Corp is not liable if you choose to bypass these measures or if circumstances beyond our control prevent their enforcement.

10. Fraudulent conduct

10.1. By creating an account or using the platform, you agree not to: (a) Hack or attempt to gain unauthorized access to the platform; (b) Modify or reverse-engineer the platform; (c) Introduce harmful code, viruses, or malware; (d) Bypass game structures to access unauthorized information; (e) Engage in cheating or collusion; (f) Use the platform for illegal activities, including money laundering; (g) Use automated tools to access the platform; (h) Interfere with the platform’s operation; (i) Attempt to disrupt the platform’s servers or database; (j) Violate any laws; (k) Interfere with the operation of any game. 10.2. You must not use the platform for any illegal or fraudulent purposes. 10.3. If King Entertainment Corp suspects you of fraudulent activity, we may suspend or deactivate your account. In such cases, we are not obligated to refund any purchases or redeem any prizes. We may also report the activity to relevant authorities and other financial institutions. You agree to cooperate fully with any investigation.

11. Intellectual property

11.1. The Platform, including all content, features, and functionality (such as games, information, software, text, displays, images, videos, audio, and the design, selection, and arrangement of these elements), is owned by King Entertainment Corp, its licensors, or other content providers and is protected under United States and international copyright, trademark, patent, trade secret, and other intellectual property laws. 11.2. These Terms of Service permit you to use the Platform solely for personal, non-commercial purposes. Using the games and Platform does not grant you any intellectual property rights in the content or Platform. You are prohibited from using the Platform or any materials for commercial purposes without explicit authorization. 11.3. By uploading or sharing content such as information, images, videos, comments, music, or profiles to any site or social media platform operated by King Entertainment Corp, you grant us an irrevocable, perpetual, worldwide, non-exclusive, royalty-free license to use it in any way we see fit, and you warrant that you have the right to do so. 11.4. You may not reproduce or modify any content from the Platform, including removing copyright or trademark notices. You also may not distribute, modify, create derivative works from, publicly display, or perform any content from the Platform, except under the following conditions: (a) Your computer may temporarily store copies of such materials in RAM during access and viewing; (b) Files automatically cached by your web browser may be stored for display purposes; (c) You may print a reasonable number of Platform pages for personal, non-commercial use, provided they are not reproduced, published, or distributed. 11.5. Any breach of these Terms resulting in unauthorized use of the Platform or its content will lead to immediate termination of your rights to the Platform, and you may be required to destroy or return any copies. All rights not expressly granted are reserved by King Entertainment Corp. Any use not permitted by these Terms is a violation of copyright, trademark, and other laws. 11.6. All trademarks and logos displayed on the Platform are the property of King Entertainment Corp or their respective owners and are protected by applicable trademark and copyright laws. You may not use them without prior written permission.

12. Third-party websites and links

12.1. The Platform may include links to third-party websites or resources, provided for convenience only. This includes links in advertisements such as banner ads or sponsored links. King Entertainment Corp does not control third-party content and accepts no responsibility for any loss or damage resulting from your use of such links. The presence of a link does not indicate an endorsement or relationship between King Entertainment Corp and the third party unless explicitly stated. Your decision to access third-party websites is at your own risk and subject to their terms of use. 12.2. Some third-party websites may attempt to engage in fraudulent activities, offering unauthorized rewards like Gold Coins or Sweeps Coins. King Entertainment Corp is not responsible for any actions taken in response to these websites. 12.3. You are solely responsible for reviewing the terms and conditions of any third-party website.

13. Platform disruptions

13.1. The Platform is provided “AS IS,” and to the fullest extent allowed by law, King Entertainment Corp makes no warranties regarding its quality, fitness for a specific purpose, completeness, or accuracy. 13.2. King Entertainment Corp is not liable for any downtime, technical issues, or disruptions in gameplay and is not responsible for unauthorized gameplay methods. 13.3. King Entertainment Corp disclaims liability for any damages arising from interruptions, data loss, communication failures, or misuse of the Platform or its content. 13.4. In the event of a Platform malfunction, all gameplay is considered void. 13.5. If a game fails to complete due to a system error, King Entertainment Corp will make reasonable efforts to restore the Gold Coins or Sweeps Coins used in the game, but failure to do so will not be considered a breach of these Terms. 13.6. King Entertainment Corp reserves the right to modify player balances in case of errors or issues related to gameplay. 13.7. King Entertainment Corp may modify, suspend, or remove games and features at any time without notice, without liability for any resulting losses. 13.8. Temporary suspensions of the Platform may occur, with or without prior notice.

14. Defects

14.1. While King Entertainment Corp takes reasonable measures to ensure the Platform is free of viruses and defects, no guarantees can be made. It is your responsibility to protect your system and reinstall data if necessary. Activities performed during any period of technical malfunction on the Platform will be considered void.

15. Privacy policy

15.1. King Entertainment Corp is committed to safeguarding your privacy and adhering to applicable data protection laws. For more information, refer to our Privacy Policy.

16. Live chat services

16.1. King Entertainment Corp may provide live chat services for support and other purposes. 16.2. Chats are monitored, and King Entertainment Corp reserves the right to review and record any statements. You must not use live chat services for illegal, harassing, or abusive purposes. 16.3. Misuse of live chat services may result in a ban or account deactivation. 16.4. King Entertainment Corp may remove the live chat service if abused and is not responsible for any damages arising from its use. 16.5. You agree to indemnify King Entertainment Corp for damages resulting from inappropriate behavior in live chat services. 16.6. King Entertainment Corp may report any suspicious activity in live chat services to the relevant authorities.

17. Complaints

17.1. For customer support or to file a complaint, you may contact King Entertainment Corp through the “Contact Us” link, live chat, or by emailing [email protected]. 17.2. All communications should be sent using the email address registered to your account to avoid delays. 17.3. Complaints must include your username, full name, a detailed description, and any relevant dates. 17.4. Failure to provide the necessary information may delay resolution. King Entertainment Corp aims to respond within 48 hours.

18. Account deactivation/suspension

18.1. King Entertainment Corp reserves the right to deactivate or suspend your account at any time for any reason without prior notice. 18.2. Reasons for account suspension include, but are not limited to, breaching these Terms, having multiple accounts, providing false information, and engaging in fraudulent or illegal activities. 18.3. If your account is suspended for violating these Terms, you may be held liable for any resulting claims or damages, and King Entertainment Corp reserves the right to adjust your account balance accordingly. 18.4. If your account is deactivated due to illegal activity, any unredeemed prizes or balances may be forfeited. 18.5. In the event of Platform closure, King Entertainment Corp will make reasonable efforts to allow prize redemption, but rights to use Gold Coins and Sweeps Coins will be terminated.

19. Indemnity and limitation of liability

19.1. You agree to indemnify and hold harmless King Entertainment Corp, including its directors, officers, employees, shareholders, agents, affiliates, parent company, and any subsidiaries, from any and all costs, expenses, liabilities, and damages (whether direct, indirect, special, consequential, exemplary, punitive, or other) that may arise from your participation, including but not limited to: (a) Accessing or using the Platform (including any Games and/or Content); (b) Facilitating or making payments into your Customer Account; and (c) Acceptance and/or use of any Prize. 19.2. To the maximum extent permitted by applicable law, under no circumstances will King Entertainment Corp or its affiliates, subsidiaries, partners, officers, directors, employees, shareholders, agents, licensors, subcontractors, or suppliers be liable to you or any other entity, even if advised of the possibility of such damages. This applies under any legal theory, whether contract, tort, or otherwise, for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost business opportunities, business interruption, lost revenue, income, goodwill, data, or other intangible losses related to your participation or any act or omission by us. 19.3. To the fullest extent permitted by law, under no circumstances will King Entertainment Corp or its affiliates, subsidiaries, partners, officers, directors, employees, shareholders, agents, licensors, subcontractors, or suppliers be liable for more than the total amount you have paid to us in the thirty (30) days immediately preceding the claim. Your sole and exclusive remedy for any dispute with us is to stop using the Platform and close your Customer Account. 19.4. You acknowledge that the warranty disclaimers in clauses 13 and 14, along with the indemnities and limitations of liability in clause 19, are essential parts of these Terms of Service, and have been considered in your decision to agree to these terms. Certain limitations in clause 19 may not apply if prohibited by your local laws, in which case only the allowable provisions will apply. 19.5. Clause 19 will survive the termination of your participation on the Platform for any reason.

20. No financial, legal, or tax advice

20.1. You will not earn any interest on outstanding or unredeemed Prizes associated with your Customer Account. King Entertainment Corp is not a financial institution, and the purchase of items on the Platform is not considered a deposit of funds. 20.2. King Entertainment Corp does not provide tax or legal advice. Players are encouraged to consult appropriate advisors for tax or legal matters.

21. Dispute resolution and arbitration agreement

Please read this section carefully as it requires arbitration for certain disputes and claims on an individual basis, limiting how you can seek relief from King Entertainment Corp. This section will be interpreted under the Federal Arbitration Act, regardless of other laws referenced in these Terms of Service. 21.1. By agreeing to these Terms of Service, you agree that any disputes, claims, or causes of action between you and King Entertainment Corp or its affiliates, agents, employees, or representatives, arising from or related to these Terms of Service, the formation of these Terms, your participation, or any other matter, will be subject to the following procedure. 21.2. Before filing a claim against King Entertainment Corp, you agree to attempt resolution in accordance with clause 17. If the complaint remains unresolved after exhausting that process, you may initiate dispute resolution as outlined in this section. 21.3. King Entertainment Corp agrees to make reasonable efforts to contact you and resolve any claim informally before taking formal action. 21.4. Arbitration Agreement: By agreeing to these Terms, both you and King Entertainment Corp agree to resolve any disputes through final and binding arbitration. 21.5. Opt-out of Arbitration: You may opt out of this arbitration agreement by contacting [email protected] within 30 days of accepting these Terms. Your email must include your full name and a statement opting out of arbitration. Opting out will not prevent your use of the Platform. We advise you to seek independent legal counsel if needed. 21.6. Arbitration Terms: You and King Entertainment Corp agree that: (a) The American Arbitration Association (AAA) will administer the arbitration under its Commercial Arbitration Rules and Supplementary Procedures for Consumer-Related Disputes (or any successor rules) effective at the time arbitration is initiated. Rules are available at www.adr.org. (b) Arbitration will be conducted on an individual basis; (c) A sole arbitrator will conduct the arbitration in accordance with AAA Rules; (d) AAA rules will govern payment of all arbitration fees; (e) Unless otherwise required by the AAA Rules, arbitration will occur in Sheridan County, Wyoming, or, if you prefer, via phone or other remote electronic means. 21.7. Canadian Residents: If you reside in Canada, clause 21 applies to you except AAA Rules will be interpreted as Canadian Dispute Resolution Procedures and Expedited Procedures of the International Centre for Dispute Resolution Canada. These rules are available at www.adr.org. Residents of all other countries remain subject to the AAA Rules as outlined in clause 21.6(a). 21.8. You and King Entertainment Corp agree that arbitration of any dispute will proceed individually. To the maximum extent allowed by law, neither party may consolidate disputes with others or participate in any class, collective, or representative actions. All such rights are expressly waived.

22. General terms

22.1. These Terms of Service represent the entire agreement between you and King Entertainment Corp regarding your use of the Platform and supersede all prior agreements or communications, except in cases of fraud. 22.2. King Entertainment Corp reserves the right to modify these Terms or introduce new procedures at any time without notice. Any changes will be posted on the Platform and will become effective immediately. Continued use of the Platform signifies your acceptance of any changes. Any dispute related to these Terms will be submitted to the courts located in Sheridan County, Wyoming, subject to clause 21 on arbitration.
