TYPE OF DATA SETS PROCESSED
We may collect two types of information from you, depending on your use of the Services. The first type of information is non-identifiable and anonymous information (“Non-Personal Data”).
We are not aware of the identity of the individual from whom we have collected the Non-Personal Data and cannot link between the data and the individual with reasonable means. Non-Personal Data which is gathered consists of technical information, and may contain, among other things, the type of operating system and type of browser, type of device, your action on the Platform or use of the Games (such as session duration) - all is considered as Non-Personal Data when collected on an aggregate basis, or otherwise not combined with any identifiers. We further collect information that identifies an individual or may, with reasonable effort, be used to identify an individual (“Personal Data”). For the avoidance of doubt, any Non-Personal Data connected or linked to any Personal Data shall be deemed Personal Data as long as such connection or linkage exists.
Some of the information identified above, including identification document information, and precise geolocation information may be considered sensitive data under certain laws (“Sensitive Data”). If required under applicable law, we will collect and process sensitive personal data only with your consent. If you choose not to provide or allow us to collect some information, we may not be able to provide you with the Service.

Account Information, KYC, Identity Verifications: In order to use our Services, you will be required to create an account (“Account”). During the registration process you will be requested to provide us with certain information such as your full name, date of birth, email address, phone number, and other verification information needed to confirm you are eligible to use the Services and use the Games. Where we use third-party advertising cookies, such third-party may independently collect, through the use of such tracking technologies, some or all types of Personal Data detailed above, as well as additional data sets, including to combine such information with other information they have independently collected relating to your online activities across their network of websites, for the purpose of enhanced targeting functionality and delivering personalized ads, as well as providing aggregated analytics related to the performance of our advertising campaign you interacted with. We do not “sell” Personal Data as most people would commonly understand that term - meaning we do not disclose your Personal Data in direct exchange for money or some other form of payment. However, due to the definition of the term “sale” under applicable US privacy laws, our practice of sharing the categories of Personal Data detailed below, when we use cookies or other third-party advertising services is considered as “selling” Personal Data.

We honor opt-out preference signals. An opt-out preference signal is a signal that is sent by a platform, technology or mechanism on your behalf that communicates your choice to opt-out of the sharing for targeted advertisements or sale of your personal information. We treat opt-out preference signals as valid requests to opt-out of the sale or sharing of your personal information under privacy laws. Right to Withdraw Consent - when we collect and process your Personal Data based on your consent, you have the right to withdraw such consent at any time.
Right to Opt-Out/Opt-out of Sale - you have the right to opt-out from receiving our marketing communications, if applicable, by unsubscribing through the message received. You further have the right to opt out of the sharing of your Personal Data for targeted or cross-context behavioral advertising or the “sale” of Personal Data as further explained under Section “Sale of Personal Data” above. We do not profile you in a manner that has a significant effect on you or other individuals, therefore we do not provide an opt-out option from such use of Personal Data.

Right to No Discrimination - You have the right not to be discriminated against for exercising any of your privacy rights. When you submit a request, we will take steps to verify your identity and your request by matching the information provided by you with the information we have in our records. In some cases, we may request additional information to verify your identity, or where necessary to process your request. If we are unable to verify your identity after a good faith attempt, we may deny the request and, if so, will explain the basis for denial and how to remedy any deficiencies, where applicable. We will honor your privacy rights request within 45 calendar days of receipt, unless we request an extension as permitted by data privacy laws. However, we will honor your opt-out request within 15 business days.

Within 45 days of receipt of an appeal, we will inform you in writing of any action taken in response to the appeal, including a written explanation of the reasons for the decisions. ANNEX A – SENSITIVE DATA AND BIOMETRIC DATA NOTICE
For the purposes of verifying your identity, geographic location, and age, as well as conducting electronic Know Your Customer ("eKYC") procedures where applicable, the Company may engage third-party service providers to perform the necessary identity verification as required by applicable laws. In connection therewith, the Company may collect and disclose to such service providers your Personal Data, as defined in the Privacy Policy, which may include Sensitive Data and Biometric Data.
The collection and processing of certain categories of Personal Data, including, without limitation, “Sensitive Data” and “Biometric Data” as such terms are defined under applicable data protection laws, may require the explicit informed consent of the data subject. Such consent shall specifically authorize the Company and its duly appointed service providers to collect, use, store, transfer, and otherwise process users’ Biometric Data as further described in this Annex A, strictly in accordance with the Company’s Privacy Policy and all applicable Data Protection Legislation.

(ii) Categories of Biometric Data Processed and Purpose of Use
Categories of Biometric Data processed may include facial features or facial scans, which may be extracted from photographic images (selfies) you are required to capture and submit for liveness detection and identity verification. Such images may be processed to confirm the liveness of your face and/or to verify that a presented identity document belongs to you as its legitimate owner. The processing of Biometric Data is carried out for purposes including, but not limited to, compliance with applicable anti-money laundering (AML), countering the financing of terrorism (CFT), anti-fraud laws and regulations, age restriction requirements, and other legal obligations, as well as the Company's customer due diligence procedures in accordance with applicable law. The Company and its third-party service providers may extract biometric identifiers and conduct facial recognition analyses as part of these processes. Biometric data may also be processed by Company’s service providers, such as SumSub, to their internal business purposes. How Biometric Data Will Be Processed
The Company and its service provider may process your Biometric Data using automated tools for reading, verifying authenticity, and other automated processing activities. This includes processing facial scans during liveness checks, video-selfie or video identification procedures, biometric authorization , face comparison between your identity document and facial image, detection of multiple identity creation, and the development of fraud control networks to detect and prevent fraud and criminal activity.
Biometric and Sensitive Data is stored in AWS Amazon or Google Cloud, depending on the Company's data storage requirements.
Retention of Biometric Data
Your Personal Data shall be retained and stored by the Company in accordance with the Company’s Privacy Policy. Where the Company utilizes SumSub's services, and SumSub independently determines compatible purposes or is subject to a legal obligation, your Personal Data, including Biometric Data, shall be retained for the duration necessary to fulfill the purposes for which the data was collected, and, with respect to residents of Texas, for a period of one (1) year from the date such purpose expires, or five (5) years from the date the data was provided to SumSub's system, whichever occurs first. For residents of Illinois, the retention period for Personal Data, including Biometric Information, shall be three (3) years from the date the data was provided to SumSub's system.
