King Entertainment Inc. and its affiliates and subsidiaries (collectively “Company”, “we”, “us” or “our”) is the operator of www.sweeps.us platform (“Platform”) in which users (“user” or “you”) can enjoy free social game play ("Games"), services, tools, and any features (collectively, the "Services").

This privacy policy (“Privacy Policy”) describes the collection, use and processing of Personal Data (as defined below), including the needed disclosure and information about the types of Personal Data collected, why we collect your Personal Data and the purposes for which we will use it, how long we will retain it, with whom we share it, what are your applicable right regarding your Personal Data, and how you can exercise them.

This Privacy Policy forms an integral part to the Terms of Use and our Sweepstake Policy (together shall refer herein as “Terms”), as applicable. Capitalized terms used herein, however not defined, shall have their respective meaning assigned to them under the Terms.

We reserve the right to amend this Privacy Policy from time to time, at our sole discretion. The most recent version of this Privacy Policy will always be posted on the Platform, and the update date will be reflected in the “Last Updated” heading. We will provide notice to you if these changes are material, and, where required by applicable law, we will obtain your consent. PROTECTING CHILDREN

TYPE OF DATA SETS PROCESSED

We may collect two types of information from you, depending on your use of the Services. The first type of information is non-identifiable and anonymous information (“Non-Personal Data”).

We are not aware of the identity of the individual from whom we have collected the Non-Personal Data and cannot link between the data and the individual with reasonable means. Non-Personal Data which is gathered consists of technical information, and may contain, among other things, the type of operating system and type of browser, type of device, your action on the Platform or use of the Games (such as session duration) - all is considered as Non-Personal Data when collected on an aggregate basis, or otherwise not combined with any identifiers. We may further process and anonymize data in a manner that the data will be Non-Personal Data.

We further collect information that identifies an individual or may, with reasonable effort, be used to identify an individual (“Personal Data”). The types of Personal Data that we collect as well as the purpose for processing such data are specified in the tables below. For the avoidance of doubt, any Non-Personal Data connected or linked to any Personal Data shall be deemed Personal Data as long as such connection or linkage exists.

Some of the information identified above, including identification document information, and precise geolocation information may be considered sensitive data under certain laws (“Sensitive Data”). If required under applicable law, we will collect and process sensitive personal data only with your consent. If you choose not to provide or allow us to collect some information, we may not be able to provide you with the Service.

PERSONAL DATA SETS WE PROCESS, PURPOSE OF COLLECTION AND USE

We have detailed below, the Personal Data processed and the purpose and operation for such processing.

Please note that, in addition to the purposes set forth above, we may use certain Personal Data to prevent potentially prohibited or illegal activities, fraud, misappropriation, infringements, identity thefts, and any other misuse of the Services and to enforce our Terms, as well as to protect the security or integrity of our databases and the Services, and to take precautions against legal liability. We will not collect additional categories of Personal Data or use the Personal Data for any purpose that is materially different, unrelated, or incompatible purpose without obtaining your consent unless we are required or permitted by applicable law.

HOW WE COLLECT YOUR DATA

Depending on the nature of your interaction with us, we may collect the above detailed Personal Data from you, as follows:

• Automatically, when you visit our Platform or interact with our Services, including through the use of cookies (as detailed below) and similar tracking technologies.
• When you voluntarily choose to provide us with information, such as when you create an Account, contact us or request support, all as detailed in this Policy.
• By our third parties service providers which collect Personal Data on our behalf, such as analytics service providers.

COOKIES AND SIMILAR TECHNOLOGIES

We may use cookies, tracking pixels (also known as clear GIFs and web beacons), third party software development kits (SDKs), and other technologies in order to maintain, provide, and improve our Platform and Services. We use Cookies for various purposes:

• Strictly Necessary Cookies: these cookies are necessary for our Platform to function and cannot be switched off in our systems. They are usually only set in response to actions made by you which amount to a request for services, such as setting your privacy preferences, logging in or filling in forms. You can set your browser to block or alert you about these cookies, but then some parts of the Platform will not work.

• Functional Cookies: these cookies enable the Platform to provide enhanced functionality and personalization (e.g., remembers your preferences so you don’t have to re-set them each time you visit). They may be set by us or by third party providers whose services we have added to our pages. If you do not allow these cookies then some or all of these services may not function properly.

• Performance and Analytics Cookies: these cookies allow us to count visits and traffic sources so we can measure and improve the performance of our Platform. This help us to know which pages are the most and least popular and see how visitors move around the Platform. If you do not allow these cookies we will not know when you have visited our Platform, and will not be able to monitor its performance.

• Marketing and Targeting Cookies: these cookies allow us to know whether or not you’ve seen an ad or a type of ad, how you interacted with such an ad, and how long it has been since you’ve seen it. We also use cookies to help us with targeted advertising. We may partner with ad networks and other ad serving providers that serve ads on behalf of us and others on non-affiliated platforms. Where we use third-party advertising cookies, such third-party may independently collect, through the use of such tracking technologies, some or all types of Personal Data detailed above, as well as additional data sets, including to combine such information with other information they have independently collected relating to your online activities across their network of websites, for the purpose of enhanced targeting functionality and delivering personalized ads, as well as providing aggregated analytics related to the performance of our advertising campaign you interacted with. These third parties collect and use this information under their own privacy policies, and are responsible for their practices.

DATA SHARING – CATEGORIES OF RECIPIENTS WE SHARE PERSONAL DATA WITH

We disclose, and may have disclosed in the prior 12 months, the categories of personal information described above in the circumstances and purposes described below. We share your Personal Data with third parties, including our partners or service providers that help us provide our Services. When we share data with service providers and partners, we ensure they only have access to such information that is strictly necessary for us to provide the Services. These parties are required to secure the data they receive and to use the data for pre-agreed purposes only while ensuring compliance with all applicable data protection regulations (such service providers may use other Non-Personal Data for their own benefit).

“SALE” OF PERSONAL DATA

Under US privacy laws, the term “sale” is referring to disclosing or making available Personal Data to a third-party in exchange for monetary or other valuable consideration, including for targeted advertising purposes. We do not “sell” Personal Data as most people would commonly understand that term - meaning we do not disclose your Personal Data in direct exchange for money or some other form of payment. However, due to the definition of the term “sale” under applicable US privacy laws, our practice of sharing the categories of Personal Data detailed below, when we use cookies or other third-party advertising services is considered as “selling” Personal Data.

The categories of Personal Data shared for this purpose includes: Identifiers (Online Identifiers such as IP and Cookie ID); Internet and electronic network activity information (Usage Data - such as your engagement with our Services); Geolocation data (such as country level extracted from IP).

You have the right to opt-out of such “sale” at any time, by changing your preference using the cookies setting tool available on our Platform. Additional Opt-Out Preference Signals and Do Not Track are available:

1. We Honor Opt-Out Preference Signals

   We honor opt-out preference signals. An opt-out preference signal is a signal that is sent by a platform, technology or mechanism on your behalf that communicates your choice to opt-out of the sharing for targeted advertisements or sale of your personal information. You can learn more about implementing opt-out preference signals here or by exploring other developing technologies and services that offer this tool.

   We treat opt-out preference signals as valid requests to opt-out of the sale or sharing of your personal information under privacy laws. Ordinarily, your opt-out preference signal is sufficient for us to honor your request, but in some instances, we may request additional information to help facilitate your request for offline sales or sharing. We will not use, disclose or retain this additional information for any purpose other than to facilitate the request

2. Do Not Track Requests

   Some browsers have incorporated “Do Not Track” features. Most of these features, when turned on, send a signal or preference to the websites you visit indicating that you do not wish to be tracked. Because there is not yet a common understanding of how to interpret the do not track signal, we currently do not respond to the browser do not track signals. However, as noted above, we do honor opt-out preference signals.

YOUR RIGHTS RELATED TO YOUR PERSONAL DATA

1. Under applicable data protection and privacy laws, individuals have certain rights and controls regarding their Personal Data we process and store. The rights you may exercise depends on the purpose of collection, your relationship with us, and your jurisdiction and the privacy laws that apply to the collection and use of your Personal Data. The principal rights that may apply to your Personal Data may include:

   • The Right to Be Informed - you have the right to be provided with information regarding our Personal Data collection and privacy practices – all as detailed under this Privacy Policy. Further, you have the right, at our option, to receive a list of the specific third parties, other than natural persons, to which we have disclosed either: (1) your personal information or (2) any personal information.    • The Right to Access - you have the right to ask us to confirm whether or not we collect and use your Personal Data, the right to know which Personal Data we specifical

   • Right to Correct - you have the right to ask us to correct or update your Personal Data we hold that is incorrect or request deletion for inaccurate Personal Data, after verifying the accuracy of the data and further taking into account the nature of the processing and the purposes.

   • Right to Delete Personal Data - you have the right to request the erasure of certain Personal Data we hold, if specific conditions are satisfied, for example, if you think we no longer need to use it for the purpose we collected it; in the event that the collection was based on your consent; where we have used it unlawfully, or; where we are subject to a legal obligation to delete your Personal Data. Request for erasure will be subject to our rights and obligations under applicable law (for example, record keeping, completing transactions, providing a service that you have requested, taking actions reasonably anticipated within the context of our ongoing business relationship with you, fulfilling the terms of a written warranty, detecting security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, or prosecuting those responsible for such activities; debugging products to identify and repair errors that impair existing intended functionality; exercising right provided for by law; engaging in public or peer-reviewed scientific, historical, or statistical research in the public interest, etc.). You are not required to create an account with us to submit a deletion request.

   • Right to Withdraw Consent - when we collect and process your Personal Data based on your consent, you have the right to withdraw such consent at any time.

   • Right to Opt-Out/Opt-out of Sale - you have the right to opt-out from receiving our marketing communications, if applicable, by unsubscribing through the message received. You further have the right to opt out of the sharing of your Personal Data for targeted or cross-context behavioral advertising or the “sale” of Personal Data as further explained under Section “Sale of Personal Data” above. We do not profile you in a manner that has a significant effect on you or other individuals, therefore we do not provide an opt-out option from such use of Personal Data.

   • Rights Related to Sensitive Personal Data - Data privacy laws may provide additional protection for sensitive personal information or data. For more information please see Annex A of this Privacy Policy.

   • Right to No Discrimination - You have the right not to be discriminated against for exercising any of your privacy rights. This includes us not: (a) denying you goods or services; (b) charging you different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties; (c) providing you a different level or quality of goods or services; (d) suggesting to you that you will receive a different price or rate for goods or services or a different level or quality of goods or services; and (e) retaliating against you for exercising your privacy rights.

   • Data Portability - you have the right to ask us to provide a copy of your Personal Data in a portable format and, to the extent technically feasible, readily usable format that allows you to transmit the Personal Data to another entity without hindrance. We will select the format in which we provide your copy.

   • Right to Appeal - If we decline to take action on your request to exercise your rights related to your Personal Data, we will inform you without undue delay within the timeframe set out under the applicable law. Our notice will include a justification for declining your request as well as information on how you may appeal, if applicable. Within the timeframe set under applicable law as of our receipt of your appeal, we will inform you in writing of any action taken or not taken in response to your appeal, including a written explanation of the reasons for the decisions. If the appeal is denied, you may submit a complaint to the applicable authority or Attorney General of your jurisdiction (including, for example, Colorado Attorney General at https://coag.gov/file-complaint/; Connecticut Attorney General at: https://www.dir.ct.gov/ag/complaint/ or (860) 808-5318; Virginia Attorney General at https://www.oag.state.va.us/consumercomplaintform).

   Note that, not all those rights apply in every jurisdiction.

2. Instructions on How to Exercise Your Rights

   You may exercise your privacy rights by emailing us at [email protected], or by completing our web form here. You may also exercise your opt-out right by clicking on the Do Not Sell or Share My Personal Information link, which can be found here.

   When you submit a request, we will take steps to verify your identity and your request by matching the information provided by you with the information we have in our records. In some cases, we may request additional information to verify your identity, or where necessary to process your request. If we are unable to verify your identity after a good faith attempt, we may deny the request and, if so, will explain the basis for denial and how to remedy any deficiencies, where applicable. We will honor your privacy rights request within 45 calendar days of receipt, unless we request an extension as permitted by data privacy laws. However, we will honor your opt-out request within 15 business days.

3. Appealing

   You may appeal a denial of your privacy right requests by emailing us at [email protected], or by completing our web form here. Within 45 days of receipt of an appeal, we will inform you in writing of any action taken in response to the appeal, including a written explanation of the reasons for the decisions. If we deny your appeal, you may submit a complaint to the Attorney General of your state.

4. Authorized agents

   Authorized agent may initiate a request on behalf of another individual, provided that they will be required to provide proof of their authorization, and we may also require that the relevant consumer directly verify their identity and the authority of the authorized agent.

Please note that closing your Account does not automatically resolved in deletion of data. If you wish to delete your Personal Data, please ensure to contact us with such request.

DATA RETENTION

We retain Personal Data we collect as long as it remains necessary for the purposes set forth above, all in accordance with applicable laws, or until an individual expresses a preference to opt-out.

In certain circumstances, we will retain your Personal Data for longer periods of time and mainly:

• Where we are required to retain Personal Data in accordance with legal, regulatory, tax, or accounting requirements;
• Where we deem retention is necessary to obtain an accurate record of your dealings with us in the event of any complaints or challenges (e.g., Product adverse event);
• If we reasonably believe there is a prospect of litigation relating to your Personal Data.

Please note that except as required by applicable law, we may at our sole discretion, delete or amend information from our systems, without notice to you, once we deem it is no longer necessary for such purposes.

DATA SECURITY

Securing your Personal Data is of high priority. We design our systems with your security and privacy in mind. We have implemented physical, technical, and administrative security measures that comply with applicable laws and industry standards, such as encryption, access restrictions and permissions, etc.

Note that we cannot be held responsible for unauthorized or unintended access beyond our control, and we make no warranty, express, implied, or otherwise, that we will always be able to prevent such access.

Please contact us at [email protected], if you feel that your privacy was not dealt with properly, in a way that was in breach of our Privacy Policy, or if you become aware of a third party's attempt to gain unauthorized access to any of your Personal Data. We will make a reasonable effort to notify you and the appropriate authorities (if required by applicable law) if we discover a security incident related to your Personal Data.

INTERNATIONAL DATA TRANSFER

Due to our global business operation, we may store or process your Personal Data in several territories. Thus, any information you provide us may be transferred to and processed in countries other than the country from which you accessed our Platform or otherwise the country of your jurisdiction. We will take appropriate measures to ensure that your Personal Data receives an adequate level of data protection upon its transfer.

ANNEX A – SENSITIVE DATA AND BIOMETRIC DATA NOTICE

For the purposes of verifying your identity, geographic location, and age, as well as conducting electronic Know Your Customer ("eKYC") procedures where applicable, the Company may engage third-party service providers to perform the necessary identity verification as required by applicable laws. In connection therewith, the Company may collect and disclose to such service providers your Personal Data, as defined in the Privacy Policy, which may include Sensitive Data and Biometric Data.

The collection and processing of certain categories of Personal Data, including, without limitation, “Sensitive Data” and “Biometric Data” as such terms are defined under applicable data protection laws, may require the explicit informed consent of the data subject. Such consent shall specifically authorize the Company and its duly appointed service providers to collect, use, store, transfer, and otherwise process users’ Biometric Data as further described in this Annex A, strictly in accordance with the Company’s Privacy Policy and all applicable Data Protection Legislation.
